COLLECTION AND USE OF INFORMATION
In order to enable you to access certain features of the Sites or to enhance your experience on the Sites, BME may collect personal information from you. However, BME will only collect and maintain personal information that you provide voluntarily (e.g., by filling out a form). For example, the Sites may contain features such as surveys, forums, games, contests, sweepstakes, subscription registrations, chats, requests for suggestions, and requests for products or services. In connection with these features, you may be asked to provide contact information (such as your name, postal address or email address), demographic information (such as your gender or age group) or information about your interests and preferences. BME may use such personal information for its own internal purposes, and may only share such personal information with third parties as described below.
In addition, BME may collect and maintain non-personal information made available through your use of the Sites (e.g. your IP address, the type of browser you are using, your operating system and the pages you visit) and non-personal information that you provide voluntarily (e.g., aggregate demographic information) (see Cookies below). BME collects this information to monitor usage of its Sites, to improve the Sites and to enhance your experience on the Sites. BME may use such non-personal information for its own internal purposes and may share such non-personal information with third parties.
At the time BME requests personal information from you, you may be asked whether you want to receive certain information from BME, including information regarding updates to the Sites, upcoming events, new releases and products and services that BME believes will be of interest to you. If you agree to receive such information (i.e., opt-in), BME may use your personal information to select the information to be sent to you and to send such information to you. You will be provided with the ability to direct BME to delete your name from its mailing lists at any time (i.e., opt-out) (see How to Opt-Out or Request Changes to Your Information, below).
At the time that BME requests personal information from you, you may also be asked whether you want to receive certain information from third parties carefully selected by BME, including products and services that BME or such third parties believe will be of interest to you. If you agree to receive such information (i.e., opt-in), BME may share your personal information with such third parties in order to enable such third parties to provide such information to you. You will be provided with the ability to direct BME not to share your personal information with third parties at any time (i.e., opt-out) (see How to Opt-Out or Request Changes to Your Information, below). However, BME will not have control over the use of any personal information that BME shared with third parties prior to receiving your direction not to share such information.
From time to time, discussion areas, chat rooms or message boards may appear on the Sites. Any information you disclose in these areas will be available to the public and may be collected and used by persons other than BME. You should not disclose any personal information in these areas that you do not want others to know. BME does not routinely monitor these areas, and you should use them only at your own risk. Additionally, BME does not have any control over the age of those who participate in these chat rooms and urges that parents exercise parental control over children. BME will, however, obtain the consent of a parent or legal guardian (as outlined below) before a user who BME knows to be a child (as defined below) will be permitted to participate in any discussion area, chat room or message board on the Sites.
Sales of BME products on-line are currently managed by third party fulfillment houses. If you purchase a product from our on-line store, personal information necessary to fulfill your order, such as your name, mailing address, telephone number and credit card number will be provided to the third parties who manage the sales of BME products. This information is provided to the third parties under obligations of confidentiality and may not be used by them for any other purposes.
POLICIES THAT APPLY TO CHILDREN UNDER
BME may collect personal information from children as described above in "Collection and Uses of Information." Before any personal information is collected from children, BME will to obtain permission from a child's parent or legal guardian as set forth below;
1. BME may ask a child to provide his or her e-mail address to BME to respond to a single, specific request from that child to send information (such as an e-mail card). BME may respond to the child's request without obtaining parental consent but will send a copy of BME's response by e-mail to the child's parent or legal guardian (using an e-mail address provided by the child). BME will delete the child's e-mail address from its records after responding to the request.
2. BME may ask a child to provide his or her e-mail address to BME so that BME can respond to a specific request from that child for information to be provided on a regular basis. Before responding to the child's request, BME will send the child's parent or legal guardian an e-mail (using an e-mail address provided by the child) notifying them of the child's request and asking them to consent to BME providing such information by responding to BME's e-mail. If the parent or legal guardian has not provided consent within two (2) weeks of the e-mail being sent, the child's e-mail address will be deleted from BME's records and no e-mails will be sent to the child. If the parent or legal guardian does consent, BME will send another e-mail to the parent or legal guardian confirming such consent. Thereafter, BME may send such information to the child and will also send a copy of each e-mail sent to the child to the parent or legal guardian.
3. Before collecting personal information, other than a child's e-mail address as set forth in (1) and (2), BME will obtain consent from child's parent or legal guardian by requiring the parent or legal guardian to either (a) send BME a signed permission form via fax or regular mail, (b) provide credit card verification, (c) make telephone contact with BME, or (d) send us an e-mail accompanied by a digital signature or a password which has been provided by BME to the parent or legal guardian.
5. BME may provide a child's personal information to third parties if a child elects to receive information about the products and services of third parties, as described above in "Collection and Uses of Information", or if BME uses a third party to process orders for products in online stores offered on the Sites. These third parties have agreed to maintain the confidentiality, security and integrity of any personal information provided to them by BME about children and only use such information in accordance with the privacy policies and practices of BME. BME will only share a child's personal information with third parties after obtaining consent from the child's parent or legal guardian, as set forth above. If such consent is obtained, BME may share the child's personal information with such third parties in order to enable such third parties to provide information or products a child has ordered to him or her but for no other purposes. A parent or legal guardian may consent to the collection and use of their child's personal information by BME without consenting to the disclosure of personal information about their child to third parties.
If BME requests personal information from a child in order for such child to participate in a particular feature of the Sites, such as a game, contest or sweepstakes, BME will only require the child to provide personal information that is reasonably necessary for the child to access such feature of the Site. BME may also request additional information but any such requests for personal information will indicate which information a child is required to provide to participate in such feature and which information is optional. BME will provide a child's parent or legal guardian with the ability to revoke their consent to the collection and use of their child's information at any time. LINKS TO OTHER SITES
BME has implemented security measures in order to protect against the loss, misuse and alteration of the personal information that you provide to BME. Any time you supply a credit card number, it is transmitted in an encrypted format using industry-standard such as an SSL (secure socket layer) encryption, or other appropriate technology. While these measures are taken to protect you, BME cannot ensure or warrant that transmission over the Internet is absolutely secure, and as such, you alone must assume the risk of transmitting such information.
Most browsers accept cookies automatically, but can be configured not to do so or to indicate when a cookie is being sent. We recommend that you do not disable your browser from accepting cookies, as it will prevent you from moving freely from page to page and from taking advantage of all of the features offered by BME on the Sites.
HOW TO OPT OUT OR REQUEST CHANGES TO YOUR INFORMATION
If you would like to change or delete the personal information that you have provided to BME, you may contact BME by e-mail at firstname.lastname@example.org. The request to change or delete the personal information must come from the original E-mail address that you registered with BME. All reasonable steps will be taken to remove your personal information from BME's database. Please note that BME can only comply with requests to change or delete information that is contained in BME's databases.
If you have allowed BME to share information with third parties, BME is not responsible for deleting your information from, or changing your information in, their databases. You will have to contact the third party separately to request that your information is deleted from, or changed in, the third parties' database. A parent or legal guardian may view the personal information that BME has collected about their child by sending an email to BME at email@example.com Parents or legal guardians will be required to provide identification before their child's information is released to them. A parent or legal guardian may also revoke their consent to the collecting of personal information about their child at any time by sending an email to BME at firstname.lastname@example.org. All reasonable steps will be taken to comply with such a request. BME may, however, terminate a child's participation in a particular feature of the Sites as a result of a parent or legal guardian the limiting information collected by BME about their child or the disclosure of such information to third parties, if the information is necessary to operate a particular feature for the child.
